1. Acceptance of Terms

Welcome to OTXHire, operated by CHALK TREE SOLUTIONS, a proprietorship firm owned by Azmina Tahniyath Khan. By accessing or using the OTXHire website ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our Platform.

2. Platform Overview

OTXHire is an online teacher recruitment platform that connects educational institutions (schools, colleges, universities) and parents with qualified teachers, professors, and tutors. We provide a platform for:

  • Recruiters (schools, colleges, parents) to post teaching job requirements
  • Job seekers (teachers, professors, tutors) to browse and apply for teaching positions
  • Facilitating communication between recruiters and job seekers

Important: OTXHire is a facilitator and intermediary platform. We do not employ teachers, nor do we directly provide teaching services.

3. User Eligibility

To use OTXHire, you must:

  • Be at least 18 years of age
  • Have the legal authority to enter into binding contracts
  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Be authorized to represent an educational institution if posting jobs on behalf of such institution

4. User Accounts and Responsibilities

4.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

4.2 Accurate Information

All users must provide truthful, accurate, and complete information. Providing false or misleading information is strictly prohibited and may result in account termination.

5. Job Posting Guidelines

5.1 Recruiter Responsibilities

When posting a job, recruiters agree to:

  • Post only genuine, legitimate teaching positions
  • Provide accurate job descriptions, qualifications, and compensation details
  • Not discriminate based on caste, religion, gender, age, or disability
  • Comply with all applicable labor laws and regulations in India
  • Not post jobs that require illegal activities or unethical conduct
  • Take full responsibility for the recruitment process and hiring decisions

5.2 Prohibited Job Postings

The following types of job postings are strictly prohibited:

  • Fake or non-existent positions
  • Positions requiring payment or fees from candidates
  • Multi-level marketing or pyramid schemes
  • Positions involving illegal or unethical activities
  • Jobs that violate Indian labor laws or regulations
  • Discriminatory job postings

6. Job Seeker Guidelines

6.1 Application Process

Job seekers agree to:

  • Provide accurate and truthful information in their applications
  • Submit genuine educational qualifications and certifications
  • Not misrepresent their experience or credentials
  • Apply only for positions they are genuinely interested in and qualified for
  • Maintain professionalism in all communications with recruiters

6.2 Document Verification

Job seekers authorize OTXHire to verify submitted documents, qualifications, and credentials. Providing fake certificates or documents will result in immediate account termination and may lead to legal action.

7. No Guarantee of Hiring or Employment

IMPORTANT DISCLAIMER:

OTXHire does NOT guarantee:

  • That any job posting will result in successful hiring
  • That job seekers will receive job offers or be hired
  • The quality, suitability, or fitness of any candidate
  • The accuracy of information provided by users
  • The conduct, performance, or reliability of any user
  • That positions posted are genuine or legitimate

We are a platform facilitator only. All hiring decisions, employment terms, and working arrangements are solely between the recruiter and the job seeker.

8. Payment Terms and Refund Policy

8.1 Service Fees

OTXHire may charge fees for certain services. All applicable fees will be clearly displayed before you commit to using such services.

8.2 No Refund Policy

All payments made to OTXHire are NON-REFUNDABLE. This includes but is not limited to:

  • Job posting fees
  • Premium listing charges
  • Subscription or membership fees
  • Any other paid services

Refunds will not be provided even if you change your mind, successfully fill a position, or do not find suitable candidates.

9. Prohibited Conduct and Misuse

Users are strictly prohibited from:

  • Creating Fake Profiles: Creating multiple accounts, fake profiles, or impersonating others
  • Fraudulent Activities: Engaging in any fraudulent, deceptive, or misleading practices
  • Spam and Harassment: Sending spam, unsolicited communications, or harassing other users
  • Data Scraping: Using automated tools to scrape, collect, or harvest data from the Platform
  • Unauthorized Access: Attempting to gain unauthorized access to any part of the Platform
  • Malicious Activities: Uploading viruses, malware, or any harmful code
  • Illegal Activities: Using the Platform for any illegal or unauthorized purpose
  • Intellectual Property Violations: Infringing on copyrights, trademarks, or other intellectual property rights

10. Content Ownership and Intellectual Property

10.1 Platform Content

All content on OTXHire, including but not limited to text, graphics, logos, images, software, and design, is owned by CHALK TREE SOLUTIONS and protected by Indian and international intellectual property laws.

10.2 User-Generated Content

By posting content (job listings, applications, profiles, etc.) on OTXHire, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for the purpose of operating the Platform.

11. Background Checks and Verification

While OTXHire strives to verify user information and credentials, we cannot guarantee the accuracy of all information provided. Recruiters are strongly advised to:

  • Conduct their own background checks and verification
  • Verify educational qualifications and certifications
  • Check references and previous employment history
  • Conduct interviews and assessments before hiring

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

OTXHire and CHALK TREE SOLUTIONS shall not be liable for:

  • Any hiring decisions or employment outcomes
  • Actions, conduct, or performance of any user (recruiter or job seeker)
  • Accuracy, quality, or legality of user-posted content
  • Loss of data, revenue, or business opportunities
  • Any disputes arising between recruiters and job seekers
  • Indirect, incidental, consequential, or punitive damages
  • Any damages exceeding the amount you paid to OTXHire in the past 12 months

13. Indemnification

You agree to indemnify, defend, and hold harmless OTXHire, CHALK TREE SOLUTIONS, and Azmina Tahniyath Khan from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or conduct on the Platform

14. Account Termination

We reserve the right to suspend or terminate your account at any time, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activities
  • Providing false or misleading information
  • Abuse, harassment, or misconduct
  • Any other reason at our sole discretion

Account termination does not entitle you to any refund of paid fees.

15. Dispute Resolution Between Users

OTXHire is not responsible for resolving disputes between recruiters and job seekers regarding:

  • Hiring decisions or rejections
  • Employment terms, salaries, or working conditions
  • Performance, conduct, or termination of employment
  • Payment disputes or salary issues

All such disputes must be resolved directly between the parties involved.

16. Data Protection and Privacy

Your use of OTXHire is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of OTXHire after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

18. Third-Party Links

OTXHire may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Access and use of third-party websites is at your own risk.

19. Force Majeure

OTXHire shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, or technical failures.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OTXHire regarding the use of the Platform and supersede all prior agreements and understandings.

22. Governing Law and Jurisdiction

Legal Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the use of OTXHire shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
